Allstate
Insurance Adjuster Whistleblower Trial
(The Allstate
Adjuster that exposed Allstate on the 20/20 television program)
The trial is over and our
Whistle Blowers didn't have a chance. They missed too many opportunities
because they couldn't get an attorney in time.
After the trial, when jury
members were questioned, they said; if they had been told that the whistle blowers
had talked to the F.B.I. and other law enforcement agency's, that would have made a
big difference in how they came to their decisions. There was just too
much information that was not admitted into evidence.
I will post the transcripts as
I get them. Please read what we have. You
have the opportunity here to be the jury of public opinion, that can eventually get all the information. I
know we have the best court system around, but in my humble opinion, it let
Harry Booth down by putting him on an un-level playing field, and then not
letting him call the witnesses he needed. No
working person can afford to defend themselves against a giant corporation like
Allstate. This internet is the big equalizer we just have to figure out
how to utilize it.

BACKGROUND
Harry Booth is a 30-year insurance adjuster who has won numerous
civic awards. During the aftermath of the
California Northridge earthquake, Mr. Booth was near an Allstate insureds home that was
being viewed by a Los Angeles TV station. When
they were told that there was an Allstate adjuster near the site, they went to him and
asked him about the homeowners complaints. Harry
Booth confirmed the homeowners complaints were accurate and their home was not being
properly repaired. The TV station went public
with a video of Mr. Booth explaining the facts as he saw them. Then, almost immediately after the story aired, Allstate
filed their vendetta lawsuit against Mr. Booth. This was the beginning of the fraud
charges and the documented evidence that Attorneys in California have been using to prove
fraud by Allstate Insurance Company against their insureds.
The 20/20 TV news program then contacted Mr. Booth.
He agreed to be video taped and answer 20/20's questions for an expose story about
Allstate Insurance Company.
Mr. Booth explained, he then called Robert Pike, VP legal counsel
Allstate Insurance Company, and asked why Allstate filed a lawsuit against him without
talking to him first. Robert Pike agreed they
should meet. At that meeting, Robert Pike
agreed to drop the lawsuit if Mr. Booth would cancel his interview with 20/20. Mr. Booth told Robert Pike that he would cancel
the interview with 20/20 if Allstate would just handle the Northridge earthquake claims
properly and take care of their insureds. Mr.
Pike refused and Mr. Booth was subsequently interviewed by 20/20 and the Allstate
Northridge earthquake story aired on national television (20/20 transcript). Since the 20/20 story the FBI has raided Allstates
offices across the country to gather evidence about the fraud that was committed by
Allstate Insurance Company against their insureds. (FBI investigates Allstate story) Attorney Generals in at least Florida
and California have also begun criminal investigations against Allstate Insurance
Company. There have recently been Grand Juries convened that are looking closely at
the practices of Allstate Insurance Company thanks to Mr. Booth.
Since the 20/20 story Mr. Booth has given expert testimony to
California Attorneys (including at least one of the class action lawsuits, that cost
Allstate over $60,000,000). The purpose of
the current lawsuit is to destroy Mr. Booth's reputation so his credibility will be in
question if he continues to testify against Allstate in the future. This is a Pulitzer Prize story and there was no
media covering this story other than Allstate Insurance
Sucks.com.
Allstate Insurance costs for preparing for their lawsuit against
Harry Booth has been estimated to be over $8,000,000.
Allstates estimated budget for the trial is approximately $200,000. This editor has seen up to 13 Allstate attorneys
in court at the same time and in pre-trial motions it has been reported that Allstate had
20 attorneys in court at the same time. It appears that Allstate will go to any length to
silence Mr. Booth. This will become evident
as the trial continues.
Allstate has succeeded in their goal to financially ruin Mr. Booth. He has spent his savings and has borrowed
everything he can to defend himself. He and
the other defendants in this case have no money left to pay for the transcripts of this
case. Allstate Insurance Sucks.com is paying
the court reporter on a day-by-day basis for the transcripts so that Mr. Booth's attorneys
can use them for cross examination of Allstates witnesses and a general review of the case
as the trial proceeds. The full transcripts
will eventually be posted on this site. There
are discussions in the transcripts that the jury has not heard and are damaging to
Allstate. The posting of these transcripts
during the trial could cause a mistrial so they will not be posted on this site until
after the trial. I will also not discuss any
of the content of the transcripts that may cause a mistrial.
Mr. Booth was not able to obtain an attorney until the day the trial
started and that was during jury selection. Like Allstate figured, other attorneys
wanted $1,000,000 in advance to take the case. Then came our heroes, Los Angeles
trial attorneys, Stephen Garcia and Lawrence Longo. These two attorneys have already
done a magnificent job. Without them Mr. Booth was dead. When I heard
Allstates attorney opening statement I thought maybe I was rooting for the wrong
side. Then came Steven Garcia and coolly explained to the jury how Allstate was
misrepresenting the facts with half truths. I bet Allstate didn't count on Steven
Garcia and Lawrence Longo to arrive. (Talk about "Cool Attorneys")
Allstate has given the court reporter a $10,000 deposit for the
transcripts. Because I am just a bystander of
this trial and a victim of Allstate like many others, I am asking for donations to pay for
the cost of the transcripts for Mr. Booth. Whether
the donation is $5, $10, $20, or $100, any thing will help.

Note: This trial became insurmountable when the Whistle Blowers
couldn't enter at least the following as evidence:
They
couldn't mention that the F.B.I. was doing an investigation or that the
defendants provided the F.B.I. and other law enforcement agency's with information.
It
could only be mentioned that 20/20 did a story on the Northridge
earthquake claims, but nothing could be said as to the content or that
the whistle blowers spoke out against Allstate Insurance Company and
their fraud.
The
whistle blowers could not mention that they brought key evidence that
was instrumental in the Sherman vs. Allstate class action lawsuit which
Allstate has pledged $60 million dollars to eventually settle. |

Tells Allstate's fabricated story and accuses Harry Booth of accepting a $10,000 kickback,
using a check receipt instead of an endorsed check, for the sole purpose
of fooling the jury. The end of part I has discussion on how to
admit into evidence, Allstate's depositions, which stack over four
feet tall and has over sixty hours of video depositions. Can you
imagine what the legal fees of that cost alone.
Allstate Shareholders should
demand an accounting of this lawsuit. If their really was a crime
WHY didn't Allstate just report it to the police.

Allstates purchased copies of the checks from Attorney Fletcher Robb's
account, and again they used the same
tactic, like with Straniere of concealing a check from the jury to try to prove a ridiculous
theory of kickbacks to Harry Booth. They were exposed here too.

| Allstate's executive William Hughes is trapped into exposing how
Allstate conceals true claims information (The QCR reports) in hidden files, and how this information is concealed from policyholders and their attorneys.
Note:
That Allstate brought William Hughes from NY to testify instead of
bringing Dan
Frum and Dale Tyler, the two Allstate managers, that had direct knowledge
of this case and personally authorized all checks to Tom Conrad.
Tyler & Frum were accused of conspiring with Tom Conrad and are alleged to be the
real crooks in this case. (It
will be interesting to see how Tyler & Frum fare with the Grand
Jury.)

| Allstate's star witness Tom Conrad, a known perjurer, thief, tax evader
and deadbeat dad, frames Harry Booth with testimony that appears bought and paid for by Allstate.
Note:
After the first few minutes Allstate's attorney appears to be testifying and Conrad continually says "correct", "correct," "correct". In law, this is called leading the witness, something that is done with a hostile witness or one who is
unreliable.
Normally, a hostile witness (or an unreliable
one) is so identified by the attorney; and the court is asked for permission to lead the witness. This was an unusual line of questioning at the very least and was done over defense attorney's objections because normal procedure was not followed.
Note:
That attorney Garcia exposes almost all Conrad's testimony as
perjury. Would you believe anything this person said???
Conrad is all that Allstate had to offer,
he was their whole case. AMAZING

thing that has occurred is that there has been an exposition of how

certainly run this up a flagpole to deflect negative publicity.
The final

asked, and I personally await the final answer, which will certainly
come in another venue, in another place, in another time, and I would
certainly be proud to ask the question."

I am reserving a conclusion at
this time. So many things came to play in this trial that it will
take time to sort them out.
One thing I know for sure is
that there were plenty of "Un-Clean
Hands" around, and they weren't Harry Booth's.
