Don't know how you can not have a copy or where you can get one, but I am looking at my Delux policy and here is what it says about water damage under Loses We Do No Cover Under Coverages A and B.

We do not cover loss to the property described in Coverage A Dwelling Protection or Coverage B Other Structures Protection consisting of or caused by:

1. Flood, including, but not limited to, surface water, waves, tidal water, or overflow of any body of water, or spary from any of these, whether or not driven by wind.

2. water or any other substance that backs up through sewers or drains.

3. Water or any other substance that overflows from a sump pump, sump pump well or other system designed for the removal of subsurface water which is drained from a foundation area of structure.

4. Water or any other substance on or below the surface of the ground, regardless of its source. This includes water or any other substance which exerts pressure on, or flows, seeps, or leaks through any part of the residence premises.


As you stated, the water came from the well that was left on and seeped up through the crawl. I know it sucks, but this is where they are denying your claim.

As for your statement regarding insurance companies and mentioning them during lawsuits, you are correct sort of. If you sued Allstate in this case you would have to mention them. Where they can't be brought up is in third party claims like an auto accident. In those cases you are suing the car owner or driver and not the insurance company. The government set it up this way so that the jury would look at the facts and not just find for the plantiff because the deep pockets are in the back ground. It is also because your average person hates insurance companies and would most likely rule for the plantiff and not always for the correct reason.

Hi, Since allstate has 'somehow" forgotten or most likely intenionally chosen not to provide me with the FULL copy of my homeowners "deluxe plus" policy listing all coverages and exclusions I STILL can't review it and provide to state insurance board. Does anyone out there have a FULL copy of this joke of a policy? Interesting how this works, if you have ANYTHING at all financed you HAVE TO have insurance yet claims are seldom paid by this sorry a$$ company. and since finding this site I have read about how some states don't even allow you to mention that insurance company is involved during lawsuit to get paid for damages. WTF!!!! is this Mafia or what, paying extortion money for supposed protection, yet when it comes time to collect............

Side note here to my complaint about allstate, I have for almost a month now been trying to get allstate to provide me a FULL copy of my insurance policy listing ALL exclusions and covered items, for some reason that just isn't happening, wonder why? maybe editing it to make sure it does not cover damages!!!

I "had" my homeowners insurance with allstate (alljoke) for approx. 6 years, my EX wife was an allstate agent and had gotten for us the allstate "deluxe PLUS" coverage WHAT A JOKE!!! One of the kids left well pump turned on and water built up and eventually seeped under house into crawl space over the course of a couple days the crawl space filled with water and ruined the furnace and water heater under the house. The adjuster took less than 1 minute to say "not covered, that is considered "ground water" and not covered by your policy" I guess it's a good thing I had their "DELUXE PLUS" homeowners policy, if I had only had basic coverage I have no doubt they would have charged me for the visit!!!! They have shafted the wrong person this time, I am now a VERY verbal enemy of all"joke" and have already convinced several persons to switch insurance, also plan to work with state insurance board to fight this. This joke of a company is giving all insurance companies a bad name..

That (SB) Sump Pump Backup and Overflow Endorsement is needed for claims like these.

Also - be sure to get flood insurance in case you do not have it. A lot of people in Georgia are wishing they bought flood insurance now as a result of the Sept 13, 2009 floods. The biggest sadness about most of these people not having flood insurance is due to the fact that they were told by NFIP that they did not live in a flood plain and per the National Flood Insurance Program maps they had little to no exposure to flood perils. Well it is too bad that now we learn that those NFIP flood maps are not as good as we believed they were. It is not even the fault of these people for not having flood insurance because they never knew they needed it. I would not have bought flood insurance either if I were told that there is little to no chance of me experiencing a flood loss. Some people lost their homes. An entire subdivision was condemned as a result of these floods. I just completed an exam and her is one of the questions:
Which is the most dangerous peril?
Hail
Hurricanes
Tornado
Floods

Well the answer is Flood.
